1. Introduction

This Manual is published in terms of Section 51 of the Promotion of Access to Information Act, 2000 (Act No. 2 of 2000) (“the Act”). The Act gives effect to the provisions of Section 32 of the Constitution, which provides for the right of access to information held by the State and to information held by another person that is required for the exercise and/or protection of any right.

3. Categories of Records

Records are kept in accordance with the following legislation (this is not an exhaustive list):

• Nonprofit Organisations Act, No. 71 of 1997

• Basic Conditions of Employment Act, No. 75 of 1997

• Labour Relations Act, No. 66 of 1995

• Income Tax Act, No. 58 of 1962

• Companies Act, No. 71 of 2008

• Promotion of Access to Information Act, No. 2 of 2000

Please note that requesting a record does not automatically mean you will be granted access. The Helderberg Cardiac Support Group reserves the right to refuse access as provided within legislation.

4. Request Procedure

A requester must use the prescribed form (Form C) to make a request for access to a record. This must be made to the Information Officer at the address, fax number or electronic mail address provided.The requester must provide sufficient detail on the request form to enable the Information Officer to identify the record and the requester. The requester should also indicate which form of access is required and indicate if they wish to be informed in any other manner and state an address or fax number in the Republic.

5. Availability of the Manual

This Manual is available for inspection during office hours at the offices of the Helderberg Cardiac Support Group free of charge. Copies of this Manual may also be obtained from the South African Human Rights Commission and the website of the Helderberg Cardiac Support Group.
